All bookings (including direct bookings and bookings via a travel agent) are made with Expedition Exclusive (JLB Group Pty. Ltd ABN 906 098 001 33). By booking a trip with us you are deemed to have agreed to these Booking Conditions (which constitutes the entire agreement between you and us) and your booking will be accepted by us on this basis. The services to be provided are those referred to in your booking confirmation invoice.

By placing orders via Expedition Exclusive you warrant that you are over the age of 18 years old and if you are placing orders via Expedition Exclusive on behalf of any other persons you warrant that you are legally authorised to act on their behalf.

You are required to pay a non-refundable deposit of $500 per person per trip for your booking to be confirmed (except for the LOW COST products, the non-refundable full payment is required at the time of booking to confirm the LOW COST bookings with us). If your booking is made within 56 days of the departure date then the full amount is payable at the time of booking.

If we accept your booking we will issue a confirmation invoice. A contract will exist between us from the date we issue the confirmation invoice or if you book within 7 days of departure the contract will exist when we accept your payment. Please refer to your booking confirmation invoice for details regarding final payments. Payment of the balance of the trip price is due 56 days before the departure date. Please note that full payment is required at the time of booking for LOW COST bookings. If this balance is not paid on or before the due date we reserve the right to treat your booking as cancelled.

Our trip prices are subject to variable and seasonal pricing, both of which are standard practice within the travel industry. This means our trip prices may vary at any time in accordance with demand, market conditions and availability. It is likely that different passengers on the same trip have been charged different prices. Your best option if you like the price you see is to book at that time. Once you have received a quote the price will be locked in provided you pay the required deposit prior to the quote's expiry. Any reduced pricing or discounts that may become available after you have paid your deposit will not apply. If you wish to cancel your booking to take advantage of a cheaper price, full cancellation conditions apply. The most up to date pricing is available on our website www.expeditionexclusive.com.au. Prices are based on currency exchange rates as of June 2016; note that prices may vary depending on which currency the booking is made. We reserve the right to impose surcharges up to 56 days before departure due to unfavourable changes in exchange rates, increases in airfares or other transportation costs, increases in local operator costs, taxes, or if government action should require us to do so. In such instances we will be responsible for any amount up to 2% of the trip price and you will be responsible for the balance. If any surcharge results in an increase of more than 10% of the trip price you may cancel the booking within 14 days of notification of the surcharge and obtain a full refund. We will not surcharge any booking for travel within the validity once paid in full. Air Passenger Duty is not included in the price of your air inclusive trip and it needs to be paid on arrival. Please note that a surcharge may be applied to all purchases made by credit card.

In order for us to confirm your travel arrangements you must provide all requested details with the balance of the trip price. Necessary details vary by trip; they include but are not limited to full name as per passport, date of birth, nationality, passport number, passport issue and expiry date and any pre-existing medical conditions you have which may affect your ability to complete your travel arrangements. On some more demanding trips we also require you to complete and forward a Self-Assessment form. Failure to provide requested details may result in additional charges or non-refundable cancellation of your trip.

If you cancel some or all portions of your booking cancellation fees will apply. A cancellation will only be effective when we receive written confirmation of the cancellation. If you cancel a trip:

- 56 days or more prior to departure, we will retain the deposit;

- Between 31 and 55 days prior to departure, we will retain the deposit or 50% of the total booking cost; whichever is greater, and

- 30 days or less prior to departure, we will retain 100% paid by you in connection with the booking.

Note: Different cancellation conditions including higher charges apply to some styles of trips and the LOW COST bookings (such as bookings purchased from a third party/ special promotions, etc.) are non-refundable at any time after the booking is made. Your booking consultant will advise if differences apply and details can be found in the Essential Trip Information relating to your trip. You are strongly advised to take out cancellation insurance at the time of booking which will cover cancellation fees. If you leave a trip for any reason after it has commenced we are not obliged to make any refunds for unused services. If you fail to join a tour, join it after departure, or leave it prior to its completion, no refund will be made. The above cancellation fees are in addition to fees which may be levied by accommodation providers, travel agents or third party tour and transport operator fees.

We may cancel a trip at any time up to 45 days before departure. We may cancel a trip at any time prior to departure if, due to terrorism, natural disasters, political instability or other external events it is not viable for us to operate the planned itinerary. If we cancel your trip, you can transfer amounts paid to an alternate departure date or receive a full refund. In circumstances where the cancellation is due to external events outside our reasonable control refunds will be less any unrecoverable costs. We are not responsible for any incidental expenses that you may have incurred as a result of your booking including but not limited to visas, vaccinations, travel insurance excess or non-refundable flights.

Expedition Exclusive reserves the right to refuse and/or remove customer from our tours for reasons that impact on the enjoyment or safety of other tour members, including but not limited to, the medical, physical, or mental inability of customers to undertake the arrangements of the tour, unsocial or unruly behaviour, or the carriage of prohibited substances and materials.

We also retain the right to refuse service at any stage before or after booking to any customer or agent that we reasonably determine:

• Is disrespectful or abusive to our staff;
• Is likely to disrupt the smooth running of our daily business or tour operations;
• Is likely to engage in anti-social, unethical or immoral behaviour, or any behaviour that may jeopardise the safety or enjoyment of other tour participants;
• Is likely to undermine the integrity, or bring into disrepute, our company in any way or form;
• Has expectations or demands that are: unable to be satisfied; unrealistically or unreasonably excessive; misaligned or incompatible with our core values, principles and practices; or inconsistent with the product or service standards that we can deliver;
• Is in breach of our Booking Conditions.

 

If you wish to transfer from one trip to another or transfer your booking to a third party you must notify us at least 56 days prior to the proposed departure date. A fee of $200 per person per change will apply (in addition to any charges levied by hotels, ground operators or airlines). If you notify us less than 56 days prior to the proposed departure date the refund policy applicable to cancellations will apply. Transfers to a third party are only permitted where the transferee meets all the requirements in relation to the trip, and transfers to another departure can only be made to a departure within the current validity period. Amendments to any other arrangements made in conjunction with your trip will incur a $150 administration fee per booking per change. This fee is in addition to any charges levied by hotels, ground operators or airlines. No amendments are permitted to your booking within 30 days of departure.

You warrant that you have a basic level of physical fitness and mobility and are able to negotiate uneven surfaces, climb stairs and board boats.  Expedition Exclusive advises that you should check with your preferred healthcare professional about medical vaccinations and health requirements at least 45 days prior to departure, as some vaccinations require 30 days or more to be effective.  Proof of vaccination may be required for visa purposes by certain countries and it is your responsibility to ensure that you are able to provide such proof. We are not responsible for checking safety and security conditions, vaccinations or additional health requirements in the regions you will visit or transit. If you intend to travel to Tibet you are required to provide a doctor's certificate stating that you are fit to travel and that your blood pressure and heart condition are able to accommodate high altitudes. We are unable to act as your agent if you are pregnant past your 6th month of pregnancy.

All travellers requiring special assistance are welcomed, however, they must be accompanied by a companion capable of providing all necessary assistance and any disability or medical condition requiring attention must be notified to JLB at the time of placing your order.  It is the traveller's responsibility to ensure that the selected tour is suitable for their individual needs, and we are not liable for any expense, cost or loss incurred if the travel product is unsuitable. We are unable to provide individual assistance to any traveller as part of the travel product and reserves the right to refuse to act as your agent if we believe in our reasonable opinion that you have the potential to affect the health, safety and enjoyment of other travellers travelling with you.

You must carry a valid passport and have obtained all of the appropriate visas, permits and certificates for the countries which you will visit during your trip. Your passport must be valid for 6 months beyond the duration of the trip. It is your responsibility to ensure that you are in possession of the correct visas, permits and certificates for your trip; please refer to the Essential Trip Information for details. We are not responsible if you are refused entry to a country because you lack the correct passport, visa or other travel documentation.

Travel insurance is mandatory for all our travellers and should be taken out at the time of booking. Your travel insurance must provide cover against personal accident, death, medical expenses and emergency repatriation with a recommended minimum coverage of US$200,000 for each of the categories of cover. We also strongly recommend it covers cancellation, curtailment, personal liability and loss of luggage and personal effects. You must provide proof of your travel insurance on the first day of your trip; you will not be able to join the trip without it. If you obtain travel insurance through us you acknowledge that you are satisfied with the level of insurance we have arranged.

While we endeavor to operate all trips as described we reserve the right to change the trip itinerary. Please refer to our website before departure for the most recent updates to your itinerary.

Before departure: if we make a major change we will inform you as soon as reasonably possible if there is time before departure. The definition of a major change is deemed to be a change affecting at least one day in five of the itinerary. When a major change is made you may choose between accepting the change, obtaining a refund of money paid on the land portion of the trip only or accepting an alternative tour offered.

After departure: we reserve the right to change an itinerary after departure due to local circumstances or events outside of our control. In such emergency circumstances the additional cost of any necessary itinerary alterations will be covered by you. Please note we are not responsible for any incidental expenses that may be incurred as a result of the change of itinerary such as visas, vaccinations, involuntary airline schedule changes or non-refundable flights.

You acknowledge that the nature of the trip is adventurous and participation involves a degree of personal risk. You will be visiting places where the political, cultural and geographical attributes present dangers and physical challenges greater than those present in our daily lives. We use information from government foreign departments and reports from our own contacts in assessing whether the itinerary should operate. However it is also your own responsibility to acquaint yourself with all relevant travel information and the nature of your itinerary. You acknowledge that your decision to travel is made in light of consideration of this information and you accept that you are aware of the personal risks attendant upon such travel.

We are only responsible for placing orders of the travel products that you wish to purchase with third-party suppliers, and does not fulfil the orders or provide the travel products.

We are acting as your agent in placing any orders for travel products on your behalf, and does not provide the transport, accommodation, meals or other facilities described as part of the travel products which are provided by third-party suppliers, such as air and land carriers, cruise operators, hoteliers or suppliers of other services as principals.

All travel vouchers or confirmations issued are subject to the third-party suppliers' contracts and terms and conditions of supply which thereby constitutes the sole contract between the principal and the individual redeeming the travel vouchers or confirmations. Acceptance of the travel vouchers or confirmations constitutes acceptance of the foregoing.

In the absence of its own negligence, we are not liable for any expense, costs or loss incurred in relation to any acts, omissions or defaults, whether negligent or otherwise, by third-parties or by you and/or events that are beyond our control including force majeure or other events, such as war, civil disturbance, fire, floods, severe weather or acts of God.

We are not represent or guarantee the standard or fitness for purpose of the travel products that you purchase.

In the event that we are found liable for any loss or damage which cannot be excluded or despite the limitation above, then to the maximum extent permitted by law, our liabilities will not exceed the fees that you paid to JLB or AU$100.00, whichever is the lower amount. 

By purchasing this tour you are agreed to attend the itinerary as what is listed, any change/no-show may cause the cancellation of tour at no refund.

The traveler must strictly stay with the group according to the set itinerary from beginning to end. Traveler is not authorised to leave the group or forfeit any day(s) or set activities at any stage, unless prior written consent is provided by Expedition Exclusive.

Failure to show up or check in on time will result in the automatic cancellation of all onward flights and/ or arrangements, at no refund. 

Optional Day-Tour and activities not included in the trip price do not form part of the trip or this contract. You accept that any assistance given by your group leader or local representative in arranging optional activities does not render us liable for them in any way. The contract for the provision of that activity will be between you and activity provider.

Travelers may be given the opportunity to shop as a group for local specialty products of cultural and economic significance to the country's heritage as part of the tour learning experience. There is no obligation to purchase any goods. Expedition Exclusive Australia is not affiliated with these stores and encourage you to always request receipts and store contact details while shopping at your own discretion. Expedition Exclusive Australia and its employees are not qualified nor permitted to ensure or guarantee the quality or value of any goods purchased or the suitability of any retail outlets visited. In all cases the purchase of goods and the use of a credit card for those transactions are entirely at the customer's own risk and at all times the customer must exercise their own discretion.

To the maximum extent permitted by law, we make no representations about the suitability of travel products and information contained on this website for any purpose, and the inclusion, promotion or offering of any travel products on this website does not constitute any endorsement or recommendation by us.

An interpretation of these Booking Conditions that results in all of the provisions being enforceable is preferable to any other construction.  Any provision that is illegal or unenforceable is, where possible, to be omitted to the extent necessary to make this agreement and all applicable terms and conditions enforceable, unless it would material change the intended effect of this agreement and all applicable terms and conditions.

This agreement and all terms and conditions contained elsewhere on this wesbsite constitutes the entire agreement between Expedition Exclusive and you, and may only be varied in writing. You agree that you rely on your own enquiries in engaging our services and did not rely on any warranty or representation of any nature by us unless made in writing.

This agreement and all content in this website will be governed by and interpreted in accordance with the laws of Victoria, Australia.  You irrevocably submit to the exclusive jurisdiction of the courts of the State of Victoria.

While we endeavor to ensure that arrangements made on your behalf are implemented as contracted with third-party suppliers, the most practical way of attempting any resolution of problems which arises is for you to communicate directly with the third-party suppliers.  Your failure to attempt any direct resolution of problems with third-party suppliers may mean that any claim for compensation is reduced or denied.

If you have any complains or concerns, please contact us in writing, with the relevant supporting documentation, within 14 days of returning to Australia.
